Deceitful
I leased a new Chevy Volt on June 30, 2018, from Keyes Chevrolet in Van Nuys California. As my 3 year lease was about to end, I decided to purchase the vehicle and went back to Keyes to do so. On February 5, 2021, I completed the transaction. My Vehicle had 20,663 miles on it after approximately 2 years 8 months of driving. The dealer strongly suggested under "Optional Service Contract" that I purchase from Century Automotive a 60 month / 60,000 miles service agreement costing $2998.00. My car was totaled on October 29, 2023, with 37,647 miles on the odometer. Believing I was entitled to a refund of unused premium since I never used or required service or repair, I made a request to Century and to Keyes. That's when I discovered that 60 months/ 60,000 miles is a gimmicky way of deceiving the unsuspecting buyer. Buried deep in the hard to read carbon copy of the contract, the one given to the buyer, is a cleverly worded "Wrap Vehicle Coverage Plan" with the Terms defined as "This agreement begins on the Original Factory In-Service Date, and shall end: 60 Months from that Date, or when 80,663 Total Miles are registered on the odometer, whichever occurs first." In other words, BUYER BE WARE. I thought I was purchasing a 60 month/ 60,000 mile service agreement, but what I was buying on February 5, 2021, was a contract that expired on June 30, 2023 - the 60 months was back dated to the moment I drove the car off the lot. This material fact was never disclosed verbally or explained in writing. Of course it might have been nice, as well as possibly a legal requirement, to disclose this at the time of purchase rather than at the time of claim. No where in the purchase agreement, other than in this small little disclaimer, is there a definition of what "Original Factory In-Service Date" meant, nor is there, in any part of the agreement, a reference that June 30th, be it in 2018, when the car was originally leased of in 2023, when the contract expired. Lastly, if the dealer, Keyes Chevrolet, and the company, Century Service, had disclosed that 60 months really only meant 31 months and that 80,663 miles would only mean 37,645, for a car driven approximately 7,500 miles a year, I would have laughed and kept my $2998.00.
