I have experienced the same thing. I received a call from Bank Modification Experts offering to modify my mortgage. Since we were experiencing financial hardship I was desperate to find a solution. I check these guys out thoroughly. On March 27, 2009 I signed a contract with them. They promised to get my rate reduced to 3.5% or lower. I paid them $3,800 (money I didn't have)to begin the process right away. They told me that it would take 4-6 months to complete the process. I had them sign additional guarantees about money back return if I didn't agree to the modification arrangement. They signed the document. I didn't hear anything from them for a long time. I call a lot and from time to time heard back from them. I even got a letter from my bank stating that Loan Modification Experts had requested information from them.
I got a call last week from this 3rd party telling me that BME is out of business and they could finish the processing if I gave them another $500. I asked them to document who they are, and the third party agreement that gave them authorization to call me. Since they had all of my personal information I asked to know who gave it to them. I did not sign anything that allows BME to give out my information to any third party.
What options do I have?
